At Most Days, Inc. dba Deathclock or Deathclock.ai (“Most Days”, “we”, “us”), we take your privacy seriously. This Privacy Policy describes how we collect and process your personal information through our website, mobile application, online service offerings and other products or services (collectively, the “Services”)

We collect consumer health data in connection with our Services. Please refer to our Consumer Health Data Privacy Policy for additional information about the processing of your consumer health data, and your rights under applicable state privacy laws with respect to such data. 

Your use of the Services is at all times subject to our Terms of Use, which incorporate this Privacy Policy. When we use the term “Policy” or “Privacy Policy”, we mean both this privacy policy and our Consumer Health Data Privacy Policy. Any terms we use in this Policy without defining them have the definitions given to them in the Terms of Use.

Categories of Personal Information We Collect

We collect the following categories of personal information:

Information you provide to us, including:

  • Contact information, such as your first and last name, email address, phone number and mailing address.
  • Account information, including username and password.
  • Health and wellness related data, including medical conditions, lifestyle habits and diagnostic information such as blood test results or other biomarker panels that you choose to share with us (see our Consumer Health Data Privacy Policy [KD3]for more information). 
  • Commercial data, including purchase history.
  • Payment information needed to complete your transactions with us, including name, payment card information, and billing information. This information is processed by our payment service providers (Stripe Inc., Apple Inc.). We do not have access to your full payment card information. Please see their terms of service and privacy policy for information on their use and storage of your personal information.
  • Demographic data such as your age, date of birth, gender and race.
  • Communications we exchange with you, including support services or other types of communications.

Information we receive from third party sources, including:

  • Third-party login information, such as social network or other third-party site or service account credentials you use to access the Services. The information we receive when you authenticate through a third-party service depends on the settings, permissions and privacy policy controlled by that third-party service. You should always check the privacy settings and notices in the relevant third-party services to understand what data may be disclosed to us or shared with us.
  • Advertising partners, including information about you that we receive from our vendors who assist us with marketing or promotional services related to how you interact with our websites, applications, products, Services, advertisements or communications.
  • Data providers, including publicly available information about you.
  • Third-Party Health Tracking Apps. If you explicitly grant us permission to collect data from third-party health tracking apps, such as Apple Health or Google Fit, the information that you authorize will be transmitted to us. We use the information you share with us through third-party health tracking apps solely to provide you the Services, including to tailor habit improvement recommendations. We do not use information obtained through third-party health tracking apps for advertising nor do we sell or share such information.

Information we collect automatically, including:

  • Device data, such as your computer’s or mobile device’s operating system type and version, manufacturer and model, browser type, screen resolution, RAM and disk size, CPU usage, device type (e.g., phone, tablet), IP address, unique identifiers (including identifiers used for advertising purposes), language settings, mobile device carrier, radio/network information (e.g., WiFi, LTE, 3G), and general location information such as city, state or geographic area.
  • Usage data, such as pages or screens you viewed, how long you spent on a page or screen, the website you visited before browsing to our website, navigation paths between pages or screens, information about your activity on a page or screen, access times, duration of access, and whether you have opened our marketing emails or clicked links within them.
  • Session recording information, such as our use of third-party software that enables us to record your interactions and engagement with our websites and mobile applications for our performance analysis and product improvement purposes.

How We Use Personal Information

We use personal information in order to:

  • Provide the Services, including to:
    • Estimate your expected longevity and provide personalized habit change recommendations and insights based on the information you provide, including your blood test results and other health metrics you share with us.
    • Provide support and assistance relating to the Services.
    • Create and manage your account.
    • Process orders or other transactions.
  • Communicate with you about the Services, including to respond to your requests, questions and feedback, and sending you announcements, updates, security alerts, and support and administrative messages.
  • Send you direct marketing communications about products or services we think may interest you as permitted by law.
  • Improve and develop the Services, including testing, research, and analysis development. We may create aggregated, de-identified or anonymized data from the personal information we collect, including by removing information that makes the data personally identifiable to a particular user. We may use such aggregated, de-identified or anonymized data and share it with third parties for our lawful business purposes, including to analyze, build and improve the Services and promote our business, provided that we will not share such data in a manner that could identify you.
  • Display advertisements, including interest-based or online behavioral advertising.
  • Protect against or deter fraudulent, illegal or harmful actions and maintain the safety, security and integrity of our Services.
  • Comply with our legal or contractual obligations, resolve disputes, and enforce our Terms of Use.
  • Protect the rights, property or safety of you, us, or another party.
  • Respond to law enforcement requests as required by applicable law, court order, or governmental regulations.
  • For any other legitimate business purpose in compliance with applicable laws.

How We Disclose Personal Information

We disclose your personal information to our service providers and other third parties (described below) for the following purposes:

  • Auditing and reporting, including counting ad impressions to unique visitors, verifying positioning and quality of ad impressions, and auditing compliance with this specification and other standards.
  • Detecting security incidents, protecting against malicious, deceptive, fraudulent, or illegal activity, and prosecuting those responsible for that activity.
  • Debugging to identify and fix software bugs or crashes.
  • Short-term, transient use of personal information that is not used by another party to build a consumer profile or otherwise alter your consumer experience outside the current interaction.
  • Performing services on our behalf, including maintaining or servicing accounts, providing customer service, processing or fulfilling orders and transactions, analyzing lab results to deliver your longevity insights, verifying customer information, processing payments, providing analytic services.
  • Undertaking internal research to improve our Services.

We may disclose your personal information to:

  • Service Providers. These include:
    • Security and fraud prevention services.
    • Hosting and other technology and communications providers.
    • Laboratory data service providers to interpret your blood test results and generate the longevity insights you requested. 
    • Analytics providers. These parties provide analytics on web traffic or usage of the Services. They include:
      • Companies that track how users found or were referred to the Services.
      • Companies that track how users interact with the Services.
    • Staff augmentation and contract personnel.
    • Generative AI service providers, such as Google’s Gemini and OpenAI’s ChatGPT.
      • We maintain agreements with our generative AI service providers, which prohibit their use of personal information we provide to them for any purposes, including model training, except as necessary to provide their services to us.
    • Payment processors.
  • Advertising Partners. These parties help us market and advertise our Services and provide you with other offers that may be of interest to you. They include:
    • Ad networks.
    • Data brokers.
    • Marketing providers.
      • The information we provide to advertising partners is limited to IP addresses, device IDs and historical purchases made through the Services. We do not share health-related personal information with advertising partners. 
  • Social media services, if you interact with them through your use of the Services. 
  • Affiliates of Most Days.
  • Business transferees, such as acquirers and other relevant participants in business transactions (or diligence or negotiations for such transactions) involving a corporate divestiture, merger, consolidation, acquisition, reorganization, sale, or other disposition of all or any portion of the business or assets of, or equity interests in, Most Days or our affiliates, including, in connection with a bankruptcy or similar proceedings. Should one of these events occur, we will make reasonable efforts to notify you.
  • Other third parties at your direction or with your authorization.

Your Rights and Choices

Account information. If you have an account with us, you can review and update certain account information by logging into your account. 

Opt out of marketing communications. You may opt out of marketing-related emails and other communications by following the opt-out or unsubscribe instructions at the bottom of the emails or within the messages or other communications you receive from us. You may continue to receive service-related and other non-marketing emails or other communications.

Personal information requests 

Depending on your location and the nature of your interaction with the Services, you may have the following rights in relation to your personal information:

  • Information about how we collect and use personal information. We have made this information available to you in this Privacy Policy.
  • Access to a copy of the personal information that we maintain about you. Where applicable, we will provide the information in a portable, machine-readable, readily usable format.
  • Opt-out of the sale of your personal information or sharing of your personal information for interest-based advertising. We may share information with third-party advertising partners and allow them to collect information about your use of the Services to show you ads as described in the “How We Use Personal Information” and “How We Disclose Personal Information” sections above. Our disclosure of information to these partners may be considered a “sale” or “sharing” of personal information or “targeted advertising” under applicable laws. You may opt out of these disclosures as described below under “How to submit personal information requests”. 
  • Correction of personal information that is inaccurate or out of date.
  • Deletion of personal information that we no longer need to provide the Services or for other lawful purposes.
  • Opt out of “profiling” in furtherance of solely automated decisions that produce legal or similarly significant effects. We do not engage in such profiling.
  • Appeal our denial of your personal information request.

You are entitled to exercise the rights described above free from discrimination.

How to submit personal information requests

To opt out of our use or sharing of personal information for targeted advertising, click the “Privacy Choices” link on the footer of our website or in our mobile application and follow the instructions, or enable the Global Privacy Control setting within the browser that you use to access our Services. Learn more at the Global Privacy Control website. Please note that your opt out will be specific to the device and browser you use when you opt out. We do not have actual knowledge that we have sold or shared the personal information of children under the age of 16.

Please note that in some circumstances, your choices may be limited, such as where fulfilling your request would impair the rights of others, our ability to provide a service you have requested, or our ability to comply with our legal obligations and enforce our legal rights.  In those circumstances, we will still respond to notify you of such a decision. In some cases, we may also need you to provide us with additional information, which may include personal information if necessary to verify your identity and the nature of your request. 

Data Security and Retention

We seek to protect your personal information from unauthorized access, use and disclosure using appropriate physical, technical, organizational and administrative security measures based on the type of personal information and how we are processing that data. For example, the Services use industry standard Secure Sockets Layer (SSL) technology to allow for the encryption of personal information you provide to us. You should also help protect your data by appropriately selecting and protecting your password and/or other sign-on mechanism; limiting access to your computer or device and browser; and signing off after you have finished accessing your account. Although we work to protect the security of your account and other data that we hold in our records, please be aware that no method of transmitting data over the Internet or storing data is completely secure. We cannot guarantee the complete security of any data you share with us, and except as expressly required by law, we are not responsible for the theft, destruction, loss or inadvertent disclosure of your information or content.

We retain Personal Data about you for as long as is necessary to fulfill the purposes for which it was collected and processed or as otherwise necessary to provide you with our Services. In some cases we retain Personal Data for longer, if doing so is necessary to comply with our legal obligations, resolve disputes or collect fees owed, or is otherwise permitted or required by applicable law, rule or regulation. We may further retain information in an anonymous or aggregated form where that information would not identify you personally.

Personal Information of Children

We do not knowingly collect or solicit personal information from children under 16. If you are a child under 16, please do not attempt to register for or otherwise use the Services or send us any personal information. If we learn we have collected personal information from a child under 16, we will delete that information. Use of the Services from Outside of the U.S.

Our Services are hosted and operated by Most Days in the United States (“U.S.”). If you are using our Services from a location outside of the U.S., please be aware that the privacy and data protection laws in the U.S. differ from those of other countries and may not be afforded the same level of protection. If you are using our Services from a location outside of the U.S., you acknowledge that we may process personal information about you in the U.S. accordance with the terms of this privacy policy.  

Changes to this Privacy Policy

We're constantly trying to improve our Services, so we may need to change this Privacy Policy from time to time. If we make material changes, we will alert you to by updating the date of this Privacy Policy and posting it on our website. If required by law to provide notification of changes in another way we will do so, such as by sending you an email, and/or by some other means. If you use the Services after any changes to the Privacy Policy have been posted, that means you agree to all of the changes. Use of information we collect is subject to the Privacy Policy in effect at the time such information is collected.
